Sources of Business Law

Sources of business law are special regulatory acts. These acts contain rules through which the social relations that are formed when carrying out entrepreneurial activities are regulated, as well as organizational and managerial decisions related to the same activity.

The system of entrepreneurial law assigns specific regulations to normative documents. These features are related to the nature of the subject of regulation and are influenced by the federal state system of Russia.

The concept of entrepreneurial law is fixed in accordance with Article 71 of the Constitution. Thus, the state owns and manages federal state property, the formation of the foundations of the policy in the sphere of the country's economic development, and the establishment of legal bases for an integral market. In addition, in this article, the subjects of state regulation include currency, financial, customs, credit management, money issue, economic services of federal significance, federal banks, including the pricing of pricing. The RF is also in charge of foreign economic relations, civil procedure, civil and arbitration legislation, regulatory regulation of intellectual property. Thus, article 71 sets out the most important aspects that determine entrepreneurial activity. It should be noted that the main issues that have significance in the development of this activity are the responsibility of the legislator at the federal level. This is how consistent legislation is formed and the integrity of the economic space is guaranteed.

Sources of entrepreneurial law include norms that relate not only directly to this industry, but also to other industries. Thus, when regulating these or other relations, civil procedural, tax, and administrative norms are often applied.

Sources of business law are grouped together in accordance with different criteria. So, according to the legal force, laws and subordinate documents are distinguished.

The laws are called normative acts, which are adopted by representative bodies of state power. Other documents are considered subordinate. Among them, in particular, include acts that are taken by the president, the government, local executive bodies, departments and ministries.

Sources of business law are divided according to the subject of regulation. Thus, special, general acts and acts relating to other branches are singled out, which ensure the regulation of certain issues.

Among the common sources, it is necessary to single out the norms that regulate relations in the field of business and in other areas of life. This category, in particular, refers to the Constitution.

Special sources are fully devoted to the regulation of certain issues related to the organization and management of business activities.

To the norms of other legal branches that can be used to manage the relations of the above-mentioned activities, it is necessary to include provisions on administrative offenses , the Criminal Code . These and other normative acts establish responsibility for violations in the field of entrepreneurship. Thus, these norms have some degree of "double" status.

In accordance with the degree of systematization, codified acts are distinguished and others. The Civil Code is the main codified source of business law.
