Land plots for large families: new opportunities to solve the housing problem

Concerned about the improvement of the demographic situation in Russia, in recent years, the government has paid special attention to the problems of increasing the birth rate and every support for large families. As early as 9 years ago, the second child in the family was a big risk and the overwhelming majority of Russians considered very carefully. The situation has radically changed with the adoption of the law on mother capital for the second and subsequent children. And after a few years many mothers consider it natural to have at least two or three children. Such a mood is encouraging, allowing us to hope that the country will not allow a demographic catastrophe. Beginning with the idea of the governor of the Ivanovo region, who was working for land lots for large families of land for the construction of housing on a gratuitous basis, with the support of Dmitry Medvedev, President of the Russian Federation. In his annual address to the Federal Assembly in 2010, the Federal Law was developed and adopted by the State Duma. According to the Law of June 14, 2011 No. 138-FZ "On Amendments to Article 16 of the Federal Law" On the Promotion of Housing Construction ", lots for large families are provided to solve housing problems by building a house on land belonging to federal or municipal property.

The procedure for obtaining land, as well as the size of land plots, is established by specific laws adopted by the subjects of the Russian Federation, already at the local level.

The law was immediately taken into account by the majority of large families in various parts of Russia. However, almost immediately there were situations when the adopted law was not supported by local legislation, designed to regulate the process of obtaining land. Ambiguous signals began to emerge when land plots for large families were allocated both in prosperous territories backed by infrastructure and on families unfit for living with minors.

Moreover, local legislation often only made it difficult to enforce the federal law. First of all, large families are given far less easily land plots. At the local level, restrictions are introduced that prevent the obtaining of a site. In some areas, along with an application from a large family will be required to provide a certificate of income of the family. In the event that the aggregate income is higher than the established standard, the local authorities have the right to refuse to accept the application. Also, in order to exercise their right under the federal law, an age qualification is introduced - the children in the family must be minors, the family should not have another land owned, parents in a large family must reside at the place of the request for not less than a certain period.
According to the Moscow region, this period should exceed 5 years, and in the capital - at least 10 years. From the list of eligible potential land owners, a significant number of large families are struck out who have recently moved to another place of residence.

Nevertheless, the first year of operation of this law showed its relevance, since applications for land lots to large families are no longer calculated as units, but as hundreds of thousands. Moreover, many families have already received and started construction of new houses, and a state support program exists through the lending in the banking structures for the construction work. Of course, all the problems faced by a family with three or more children will not be resolved by the Law, but the fact is that the state needs new citizens and it takes measures to increase the population of Russia.
