LawState and Law

What goods are not refundable and how is this justified?

Perhaps there is not a single person who has never had problems related to the purchase of goods. The law that protects and defines the rights of consumers is constantly being improved. Thanks to this, we not only can replace poor-quality or unusable goods, but also get back the money in the event that the thing to us for some reason did not fit. However, it requires a thorough knowledge of what goods are not subject to return, so as not to be in an awkward position.

Theoretically, within fourteen days after the purchase, we can replace the item or return it to the store, if it does not fit us in color, size, style, or fabric quality. As a rule, we are talking about clothes and shoes. However, in every trade enterprise (including online stores), you can see the list indicating which goods are non-refundable and for what reasons. So, you can not return the underwear, personal care products, medicines and items intended for home treatment - for example, rubber products. We will not be able to return other objects with which the intimate parts of the body or the oral cavity come into contact. For example, in the list of what goods can not be returned, there were also mouthpieces for musical instruments, chinaware violins, inflatable toys. And this is understandable: it is implied that qualitative goods will go on sale again. But who would like to use what the lips of a stranger touched?

That is, the law is aimed at protecting our interests and preventing the spread of diseases. It should be noted that the above concerns only quality things. Exchange of goods of inadequate quality (if, for example, we find a defect or an industrial fault) is always allowed. Moreover, the requirement to return the goods in the undamaged packaging referred to by the sellers, when they tell us which goods are non-refundable, is in most cases illegal. After all, we can not determine the quality of things, if we do not unpack it. Also, we are not required to present a check if we can provide other proof of purchase. Rather, by law, with the return of goods we must present a check, but its absence does not deprive us of the right to return. Such a paradoxical formulation gives rise to misunderstandings, so in difficult cases it is better to contact the Committee for the Protection of Consumer Rights.

We will not be able to return the products (laces, cables, braids, fabrics), furniture, and complicated household appliances. We will repeat that it is a question of qualitative goods. With technology it is understandable: if there is a warranty period, then the manufacturer is obliged to conduct an examination and within the scope of the warranty to eliminate defects or replace the item. With the metric products, too, everything seems to be clear: then selling a piece that someone just did not fit will be much more difficult and this is due to the seller's protection. But lawmakers added to the list of furniture, books, CDs, printed non-periodicals. Here there are questions and difficulties. On the one hand, these measures are aimed at protecting trade. In all stores, the conditions for returning the goods must be specified, which must be observed. For example, in a book in a prominent place you can read an announcement that you are asked to make deliberate purchases, because to return the book, if there is no marriage in it, then we will not be able to.

The store is not a library - you will not be able to read the work and return it (the same applies to music editions). But on the other hand, what caused the ban on the return and exchange of furniture - difficult to understand. After all, it may turn out that we did not take into account all the details and the tables and cabinets simply did not fit in size. It is impossible to replace both plants and animals. Also we can not return jewelry with precious or semiprecious stones. By the way, most of the provisions of the law are reasonable and aimed at protecting us from fraud and falsification, as well as ensuring the observance of personal hygiene and sanitation.
