In this world there are quite a few different processes that are beyond the scope of the law. What do they do in such cases? The correct answer is to carry out such a procedure as legalization. How does this process happen?

Legalization - what is it?

First of all, it is necessary to determine the terminology. By legalization (legalization) is understood as official recognition by the state or giving something legal force. It should be noted that it is often accompanied by the decriminalization of some actions.

What is it? This term means a number of actions that need to be taken to get legal effect. Let's consider an example with the state. The State Duma adopts a law on a certain procedure. Then it is passed on, and the president can reject it, if something does not suit him. If satisfied, then he signs the law, and it is published. Only legal entities that engage in illegal activities or cover part of their revenues from the state use the legalization of incomes. But not everything turns out as easily as you want. Counteraction to legalization is quite high, there are many instances and bodies for fighting fraudsters. They collect and analyze the information they are interested in.

Schemes of legalization of income

But how is money laundering actually going on? There are quite a few different opportunities that allow you to whiten your earnings. To consider them all is not possible in view of the immense ingenuity and resourcefulness that criminals exhibit. But still several schemes will be considered in the framework of this article:

  1. Work with offshore companies. This action is very popular among representatives of large businesses. Its mechanism consists in the fact that states and countries-offshore have tax treaties. They prescribe that money that relates to one and the other party to the agreement (thanks to the firm that operates in the territories of both countries) can be taxed only once. And everything is done, of course, where the interest rate is lower. But this is more a tax evasion. Actually, what about the legalization process? When money is illegally withdrawn from the country and credited to the account of a company registered in offshore, in the future to return in some way to the original owner - this is money laundering.
  2. Work with real estate involving dummies. This scheme provides that frontmen (as a rule, citizens of another state) buy real estate. Then they give it to criminals who quickly sell it and get clean and legal money, actually received already by legal means.
  3. Work with front companies. This scheme provides for the creation of fake companies for one day, which disappear immediately after the fulfillment of their tasks.
  4. Schemes with earnings on the territory of other countries. Provide for travel abroad and return with amounts of money that are indicated as earned there. As evidence, fake documents on earnings and payment of taxes in the territory of another country serve.

What other types of legalization exist?

Is there anything else to say about such a process as legalization? What is this from a different point of view? We have already figured out what legalization is, what it is in practice and in what ways it is most common. And now let's talk about what might fall under this definition:

  1. Legalization of drugs. Recognition that the use, possession, production and transfer to others of all or only certain narcotic drugs is not a crime. Examples of this can be seen in the Netherlands or some parts of the United States of America.
  2. Legalization of pornography. It implies the removal of any restrictions on the distribution of products of this content.
  3. Legalization of software. Decision to stop using "pirated" software and transition to official programs.
  4. Legalization of the mat. Yes, even there is. The process implies the recognition that all obscene words are a component of a certain language, and consequently, they are no different from the usual literary speech.
  5. Legalization of prostitution. It implies the rejection of administrative and criminal prosecution of persons who are involved in prostitution. Legalization can be partial or complete. Thus, prostitutes can be released from persecution, but the owners of brothels, pimps, recruiters and similar persons who are involved in criminal activities are being criminalized.
  6. Legalization of same-sex marriage. Includes the recognition that people of the same sex can officially bind themselves by marriage.
  7. Legalization of weapons. This includes recognition of the right of citizens to own cold or firearms in possession, as well as use it. Here there are a number of nuances - so, it can be allowed to carry pistols, but it is also forbidden to have automatic weapons. Or you can wear anything, but only covertly.
  8. Legalization of alcohol. Such a name was given to the processes of abrogating dry laws in a number of countries.
  9. Legalization of migration. Under this, granting foreign citizens the right to work, reside, receive medical services and so on.
  10. Legalization of gambling establishments. Recognition that they are a legitimate type of leisure for citizens of the state.
