The object of unfinished construction: the general concept and features of registration

The object of unfinished construction is a structure that requires the investment of initial capital. Subsequently, the use of such a structure should generate revenue. However, it must be registered with a non-state owner, who has the opportunity to complete its construction. The object is firmly attached to the area on which it stands, and to transfer it to another place without destroying its elements is impossible.

In principle, any object that has not yet been completed can be called unfinished. To this category, one can also refer those structures whose construction is canned. Since the ownership right comes into effect only when the construction is completed, in order to complete the object of unfinished construction, it is necessary to perform several procedures. First of all, the possibility of buying such a structure depends on who will sell it. The procedure for the acquisition is prescribed in the legislation.

The object of unfinished construction can be transferred to a mortgage, and together with the land on which the structure is located. However, for this to happen, it is necessary to obtain a court decision that recognizes ownership of the ONS.

In order to register an object of unfinished construction, it is necessary to collect some documents: a certificate that confirms that the owner has rights to the site and the structure; Permission to erect a building; Document, which contains a full description of the design; Project and construction budget.

If the land where the work is carried out is not the property of the applicant, but he has the right of unlimited use, a document confirming this shall be submitted to the registration authorities. Naturally, in order to complete the object of unfinished construction, you must submit other documents: an act of suspension of work or conservation of the structure; Cadastral plan of the land plot ; A contract that confirms participation in shared construction (if the erection was based on it).

It is also necessary to submit a report on the number of funds that were invested in the construction of the structure. Basically, all documents must be provided by the developer to the registration authorities. If he does all the work at his own expense, you should provide a certificate stating that the owner builds the building independently.

Registration of unfinished construction is made on the basis of documents submitted to the registration authority in duplicate. Instead of originals, you can bring copies certified by a notary. It must be remembered that there is a time limit during which it is necessary to file all the papers. Also, the state establishes a certain period for which registration should be made.

In the event that after the design of such a construction developer decided to resume all work, you must notify the state authorities that will make changes to the Unified Register. In this case, ownership rights will have to be reissued.
