How do you know if the apartment is privatized or not? Basic methods

Privatization is a form of transformation of property through transfer to private hands. The purpose of the process is to attract a more efficient way of property management. Depending on the type of object, privatization of an apartment, land and property enterprises is singled out. This question may interest, for example, the relatives of the deceased person who want to sell the house. More details about where and how to find out whether the apartment is privatized or not, read in this article.

Access to data

To date, in Russia, most of the housing is privately owned. After the entry into force of the Federal Law "On Privatization", Russian citizens can receive free of charge the right to own the housing facilities they use. But some of the apartments are still in state or municipal ownership. Therefore, free privatization of the apartment was extended until 2018.

The parliamentarian made this decision, since the majority of citizens who occupy housing in emergency or dilapidated premises may lose the right to change their form of ownership. And persons who are registered as in need of square meters, may not have time to use the same right.

Privatization of an apartment legally allows citizens to make sales transactions, transfers by inheritance, etc. Participants in the process can obtain reliable information about the facility.

How to find out if the apartment is privatized or not

The easiest and most convenient way is to request information from Rosreestr. The same option would work if the housing was privatized before January 31, 1998, but then it was the object of a transaction of purchase, sale, gift or exchange. All this information is displayed in the Unified State Register of Rights to Real Estate (EGRP). This is the largest database created in 1998 with the aim of implementing state control over the implementation of transactions with real estate. In addition, it contains information on the existence of arrests or encumbrances. Any citizen of Russia can obtain information on the object by providing:

  • identification;
  • Request for data request;
  • Receipt for payment of duty.

For legal entities this list has been expanded:

  • Certificate of state registration of the institution;
  • statutory documents;
  • An extract from the govermenter;
  • Document on assignment of TIN;
  • Power of attorney and the passport of the representative of the organization.

That's where to get a certificate of privatization. The document is valid for 30 days. The information is 100% correct only on the first day of receipt of the paper. Therefore, the document should be provided to interested parties as soon as possible. If there is no data in the EGRP database, then the process of changing the form of ownership did not take place at all or was formalized before 1998 and no deals were concluded on the object.

How to obtain data through the Privatization Department

You apply to the Registration Chamber and fill out the application form. The application form is issued by the employee. A copy of the passport is attached to the document, and for legal entities an additional certificate of state registration of the company, statutory documents, a memorandum of association, a notarized power of attorney will be required. The state fee can be paid directly to the Registration Chamber through the cashier. Further, the employee will issue a "Receipt for acceptance of information for processing", in which the deadline for receipt of the statement will be indicated. Usually it is three days. On the appointed day it is necessary to come to Rosreestr with a passport, a receipt and pick up the original statement with a live signature of the registrar. The information on the privatization of the apartment contains the following data:

  • Cadastral number of the object;
  • name;
  • Purpose;
  • Exact area;
  • address;
  • The full name of the rights holders, the share of each of them;
  • Existing restrictions;
  • Existence of an agreement of equity participation;
  • Information about the current judicial requirements.

Information is provided on a fee basis. The amount depends on who is requesting the data. Individuals need to pay 200 rubles, legal entities - 600.

Alternative method

Where else can I find out whether the apartment is privatized? The key moment in the solution of this issue is the estimated time for changing the form of ownership. The law was adopted in 1991. The following 7 years, this issue was handled by the Bureau of Technical Inventory (BTI). Each department of privatization establishes its own procedure for providing data and issuing certificates. Therefore, if there is no information in the EGRP database, then you should contact this service.

Restrictions

BTI provides data to not all interested parties, but only:

  • Owners of housing, their trusted persons who can confirm their status;
  • Heirs who are entitled to receive an apartment by law or by will;
  • Law enforcement and judicial bodies in the context of current cases in the production;
  • Bodies of state power and local self-government in accordance with their territorial affiliation;
  • Statistics;
  • Tax authorities;
  • Institutions of justice that deal with state registration of rights to objects;
  • Other persons who have permits.

Free Option

How do you know if the apartment is privatized or not? In the receipt for payment of utility services there is a line "Hiring". If the apartment belongs to private property, then in this field there are dashes. If the property belongs to the state, then the line shows the amount of debt under the contract of social hiring. Privatization of the apartment is made within two months. Therefore, you can find out the exact information only on fresh receipts.

Through the Internet

It is not necessary to apply to the privatization department of NEAD to make a request. The application can be submitted through the website of Rosreestr. To do this, it is necessary to select the section "Public services" - "Registration of rights to real estate" on the main page of the service.

In the window that opens, you need to fill out the form in the following ways:

1. Type of statement - "On registered rights to real estate with publicly available".

2. Fill in the data for the object.

3. Choose the option of providing data: in paper form by mail, through the territorial departments of privatization of Moscow or any other city, in electronic form (e-mail). Enter the address for receipt of the statement.

4. Go to customer information. Here you must specify the type of applicant, name, passport data, agree with the rules for processing personal data and confirm the request.

5. The next step is to attach the document scans. To do this, first select their type (for example, passport, power of attorney), and then click on the "Add" and "Go to data verification" buttons.

6. If the form is filled correctly, then you need to send the information for processing. The number of the registered application will be displayed immediately on the page. It must be completed. In the future, you will be able to find out the status of processing the request through the site.

7. A letter with a payment code will come to the e-mail box.

You can pay for the order through the website. To do this, the letter has a link "Specify the code." Clicking on it, open a window with different methods of payment: from bank cards to payment systems. Select the one you want and make a payment. Money should be transferred within 10 working days. After that, a certificate of privatization will be sent.

Where else can you get a document? In third-party companies. If there is no desire to visit the privatization department of NEAD, information can be obtained through online ordering in special institutions. The mediators take a large commission for their services and long process the information. But this option can suit busy people and those who do not have time to go to the authorities.

How to apply for apartment privatization

The process consists of five stages. For each, you need to prepare a number of documents and submit them to the BTI or MFC (Multifunctional Center). The first stage will require:

  1. Order or contract of social. Hiring for property. These documents can be ordered at the EIRTS (Unified Information and Settlement Center).
  2. The technical passport, in which the apartment plan is indicated, can be obtained at the BTI.
  3. The cadastral passport, in which there are data on the area, volume, layout, floor, etc.
  4. An extract from the house book about the registered persons in the apartment can be obtained at the passport office, by providing the contract of social security. Hiring. The certificate is valid for 14 days.
  5. Extract from the Unified State Register of Land for the real estate object. It is issued by the MFZ after payment of the state duty in the amount of 220 rubles. Depending on the purpose for which data are requested, the document will need to wait 7 to 30 days.
  6. Excerpt from the Unified State Register of Trade Unions according to form No.3. It indicates the presence of any other real estate in the process participants.
  7. The personal account for the apartment can be obtained from the account department of the passport office. If the certificate indicates the debt for payment of utilities, then documents for further registration will not be accepted.
  8. If an outsider is engaged in privatization, then it is necessary to formalize a notarized power of attorney.
  9. The refusal to participate in privatization is granted if one of the registered persons does not take part in this process.
  10. Personal documents of the applicant:
  • passport;
  • A certificate of death of a person who lived before;
  • Certificate of marriage, the birth of children.

If in the passport the address of the apartment being privatized is indicated with errors or differs from what is fixed in the contract, it is necessary to take a certificate of the residence in the passport office.

Additionally, such documents may be required:

  • Confirming custody of a minor child.
  • For foreigners - a certificate from OVIR.
  • If from the apartment were issued minor children, which are specified in the contract of social. Hiring, they still participate in privatization. Therefore it is necessary to prepare:

    • Extracts from the home book from the new and old places of residence.

Second phase

Then you need to get a technical and cadastral passport. It is issued to the BTI on the basis of the warrant, the applicant's documents, an extract from the house book.

The third stage

It is necessary to issue an extract from Rosreestr and submit it to the Property Management Department. It is issued on the basis of the warrant, cadastral and technical passports, personal documents of all adults, extracts from the house book.

Fourth stage

The penultimate step is to formalize the privatization contract and provide it to the BTI. To this end, it is necessary to prepare, in addition to the above-described passports for the apartment and all applicants, extracts on the number of registered and personal accounts:

  • Certificates of non-participation in privatization;
  • An extract from Rosreestr;
  • An extract from the Unified State Register for each individual;
  • Additional documents for the child - instructions on the appointment of a guardian;
  • A notarized power of attorney from each participant of the process to the person who is engaged in privatization.

The minimum period for executing the contract is 2 months. Paper is issued to each participant in privatization. The state fee for registration of the document is 4800 rubles.

Fifth stage

The last step is to submit documents to the Registration Chamber for registration of a certificate of ownership. All participants who applied for such a statement must pay a state fee of 1000 rubles and wait 14 days. Registration is subject to availability:

  • Cadastral and technical passports;
  • Extracts from Rosreestr;
  • A notarially certified refusal to privatize all non-participating persons;
  • Applicants' passports, birth certificates;
  • Extracts from the home book for each participant;
  • Orders;
  • Privatization agreement for each participant in the process.

Upon completion of the procedure, an extract is issued on the ownership of the apartment.

Conclusion

The process of changing ownership of property takes a long time. But without it, it is impossible to legally execute sales and purchase transactions, it is impossible to transfer by inheritance. Therefore, it is worth to ask in advance the question of who owns the property. How do you know if the apartment is privatized or not? Submit an inquiry to Rosreestr. This can be done both in the privatization department and on the Internet. The period for receiving an extract from the USRD is three days. The certificate is valid for 30 days. Information on a fee basis is available to all interested persons. If the change of ownership transaction was carried out before 1998, then this information can be requested from the BTI. But this can only be done by the owners of the apartment, their heirs or state agencies, provided there is a specific permit.
