How can a Counsel on Criminal Cases Help in the Conditions of Russian Justice?

All of us are Russians, we are well aware of the corruption of the law enforcement system and its imperfection:
- former policemen, now policemen, for bribes release infringers of the administrative legislation;
- firefighters and inspectors from the Ministry of Emergency for money turn a blind eye to blatant violations of safety standards;
- Judging scales for a certain bribe or on a call "from above" go to the side of a more serious and strong participant;
- operatives, investigators and investigators for offering break up cases, release criminals from custody and participate in raider attacks ...

Undoubtedly, not all law enforcers are engaged in the "deeds" described above, but according to opinion polls, our people in overwhelming majority believe the opposite.
Citizens express special distrust to the work of "bodies" from the sphere of criminal justice, when the "judicial and investigative conveyor" grinds people's lives, regardless of alibis and other evidence of innocence or the requirements of the law on the qualification of actions.

In such circumstances, an attorney for criminal cases is indispensable, which will attentively monitor the observance of the rights and freedoms of his client, fight for his freedom, and will not allow "superfluous" excess. Although investigators, prosecutors and courts diligently interfere with lawyers, ignoring the instructions of the criminal procedure legislation on the adversarial nature of the parties and acting on the principle of "hand washing their hands," a good and qualified defender knows perfectly how to circumvent this vicious circular defiance.

Is a lawyer so useless in the criminal process, how can it seem at first glance?

Some people who previously faced criminal trials as victims or accused can say: the effectiveness of the work of a lawyer in our country is low.
However, I dare not agree with this fabrication - there is an unshakable regularity in the affairs of the judiciary - all those who have passed the court are always divided into two parts - "contented" and "dissatisfied", it is understandable - someone's wishes are supported, somebody's not.

There are advocates-extras, attracted to provide services at the expense of the state. It is these advocates who generate myths about the uselessness of a lawyer in criminal proceedings. They do not receive a fee and thereby justify their inaction, which is a gross violation of the norms of professional ethics of the lawyer! Of course, any work should be paid, but a professional lawyer who sees a poor or needy client should not turn away from him. He, as a doctor, is obliged to show all his qualities and skills for the just resolution of the matter and the salvation of human life.

A lawyer who is fully committed to professional duty is not just present at investigative actions or at court hearings, he painstakingly analyzes the evidentiary base and reflects it in complaints and petitions, seeking results.
It is also worth considering here the important fact that in most cases suspects or accused are still implicated in the incriminated acts.
However, they do not want to bear responsibility and expect a lawyer a miracle, or rather, that he "otmazhet." This is an extremely incorrect approach, since in court, having received a sentence, they immediately begin to make claims, insulting their defender and accusing them of uselessness or inaction. Meanwhile, the task of a lawyer in a criminal case is to minimize the punishment and only in case of obvious non-involvement of his client, to seek his full justification. It is foolish to believe that if there are specific clues, it is possible to avoid a "deadline", but getting less than what is supposed, perhaps, in this situation is almost salvation.

That is why the lawyer in the criminal trial is not a nominal, but quite efficient and effective participant who will stand guard over the law, ensuring a fair verdict!
