The procedure for forming the Council of Federation

The procedure for the formation of the Federation Council is enshrined in the relevant law. So, the structure includes 2 representatives from the subject of the country. The State Council of the Russian Federation includes, one by one, the executive and representative (legislative) authority of the entity.

As a member of the body in question, a Russian citizen who is not younger than thirty can be appointed (elected). In this case, a person must have the right to choose and be chosen in accordance with constitutional norms.

The procedure for the formation of the Federation Council provides that members - representatives of the legislative bodies of the authorities of the subjects are elected for the term of office of these bodies, and in their formation - for the period of the powers of deputies elected once.

Representatives of the bicameral legislature are elected in turn from each chamber for half the period of activity of the relevant chamber.

The procedure for forming the Council of Federations provides for consideration of candidates for election as chairman.

A representative of the executive body of the entity is appointed by the official (the head of the executive higher body) of the entity.

The procedure for the formation of the Council of Federation presupposes a secret ballot in the election of a representative of the legislative institute of power. The decision is made by the corresponding decision.

The decision taken by an official on the appointment of a representative from the executive body is fixed by an appropriate decree. This decree is sent to the representative body of the state authority of the subject within three days.

The procedure for the formation of the Federation Council provides for certain conditions for the entry into force of decrees and decisions on appointments. For example, the decision to accept a representative from the executive power body in the event that at an extraordinary (regular) meeting of the representative body of the state authority of the subject, two-thirds of the total number of deputies will not cast their votes against the appointment.

Decisions on the appointment (election) of members of the State Council are sent by the bodies that adopted them to the Federation Council.

According to the legislation, the formation of the body in question was completed by the beginning of 2002.

In accordance with constitutional norms, a list of issues that the State Council is responsible for is established. Among them are the following questions:

  1. Confirmation of changes in the boundaries of subjects.
  2. Approval of the President 's decree on the introduction of martial law in the country .
  3. The appointment of presidential elections.
  4. Deciding on the possibility of using the country's Armed Forces beyond its borders.
  5. Withdrawal of the President from office.
  6. Appointment of judges of the Supreme, Constitutional, Supreme Arbitration body of justice.
  7. Appointment and release from the powers of the Prosecutor General of the country.

According to the relevant constitutional norm, the State Duma and the Federation Council form the Accounts Chamber. The order of its activities, the composition is fixed legislatively.

The Federation Council nominates the Chairman from among its members, as well as its deputies. They are aware of the internal regime of work, they are holding meetings. The State Council forms commissions, committees, conducts parliamentary hearings related to matters of its jurisdiction. In the structure of the body, the formation of parliamentary associations and factions is inadmissible.

Ensuring collegial and operational discussion of any urgent issues on the activities of the State Council related to the permanent functioning of the body is carried out with the assistance of the Council of the Chamber. This collegial body acts constantly. It includes the deputies of the Chairman of the State Council, the Chairman, chairmen of the commissions and committees of the Council, as well as the Commission on Parliamentary Procedures and Rules.
