LawState and Law

The most famous lawyers

Jurisprudence as a science and a kind of professional activity begins from the time of the Roman emperors. It was the Romans who laid the main pillars of all modern legal practice. Therefore, it is not surprising that for many centuries there have been constant ideas about the ideal specialist. In the history of the Russian state there are also a number of individuals who have made the most significant contribution to the formation of the national legal system.

Famous legal theorists

Any legislative act is issued on the basis of the study of the process of law enforcement, an important role in jurisprudence is played by theorists who systematize through the application of scientific methods the reality and develop an academic discipline for training new personnel. The most famous lawyers in Russia in this field of activity: NM Korkunov, KP Pobedonostsev, BN Chicherin, MI Braginsky.

Nikolai Mikhailovich Korkunov

N. M. Korkunov (1853-1904) - a native of the academician's family, a graduate of the St. Petersburg University, and later - a teacher. From the 70's to the 90's of his century, he gave lectures on state law at the Faculty of Law at the Alexandrov Lyceum and the Military Academy. Among his works - "Decree and Law", "Russian State Law". About a year, Nikolai Mikhailovich held the post of State Secretary in the State Council.

The most important work, Lectures on the General Theory of Law, was one of the main textbooks in Russian universities, was also translated into French and English, and Western lawyers considered the Lectures a comprehensive study in the framework of a positive theory of law.

Since the convictions of NM Korkunov did not correspond to the ideology of the Soviet period, his work was studied only as an experiment of liberal scientists of the past, and the modern science of referring to weighty creativity is rare, but it should not be forgotten that it was the fruits of Korkunov's activity, his Teaching work was the beginning of such branches of science as administrative, international, state law.

Konstantin Petrovich Pobedonostsev

KP Pobedonostseva was raised by a pious professorial family. The well-known Russian lawyers of that time sometimes had rather archaistic views - the law, in their opinion, should be based on Orthodox dogmas and moral principles. Pobedonostsev held a similar idea, considering, for example, that elections do not benefit the society by engendering cheap political games. The people, according to the scientist, should not have the opportunity to express will, since the divine intent is that the entire leadership of the country is given to the monarch.

In Soviet literature, KP Pobedonostsev was represented as a champion of extreme reaction, but his quotation was not ruled out, since the work of this scientist was considered classic: knowing the history of law perfectly well, Pobedonostsev skillfully analyzed individual legal institutions through a historically comparative method.

In addition, his course of civil law, based on the fundamental knowledge of the Russian law school, was of great importance.

Boris Nikolayevich Chicherin

Not all well-known Russian lawyers of the century before last can boast such a broad outlook as BN Chicherin, who was both a supporter of neo-Hegelianism, a historiographer, and a natural science specialist. While teaching, the scientist understood the significance of the era of the Great Reforms for the history of the Russian people. As a teacher, Chicherin BN tested an entirely new method of teaching, based on the study of the theory of public administration. However, the views of the scientist were conservative - as a true representative of the elite of the time, he believed that Russian society can not exist without an autocrat. B. N. Chicherin can be considered the founder of the school of legal historiography, since the scholar's pen belongs to such works as "History of political doctrines", "Property and state", "Experiments on the history of Russian law".

Also, few well-known lawyers, unlike Chicherin BN, have a merit in the list of merits in the teaching of liberalism, the formulation of its basic postulates.

Gabriel Feliksovich Shershenevich

Shershenevich GF - comes from a noble Polish family, a graduate of Kazan University. The sphere of interests of the scientist at the time of the beginning of teaching activity was such civil law institutions as securities, legal entities. Shershenevich GF also dealt with issues of commercial law, in the field of which the dissertation research was developed.

The first monographs of the brilliant theoretician were devoted to the general course of civil law, which differed in depth study of legislative and judicial acts, contained many generalizations and synthesis. Later Shershenevich GF tries to dogmatize the history of the philosophy of law, to systematize the picture of disparate knowledge.

The scientist for the first time provided students with a systematic textbook on civil law, spoke in favor of codifying legislation and eliminating legal dualism.

Practice lawyers: the elegance of judicial speech

Judicial competition of the parties is a duel of minds, which requires a talent of eloquence, the ability to make decisions spontaneously. Practice, in turn, provided food for thought to theorists. Among the most famous - FN Plevako, AF Koni, VD Spasovich and others. The judicial speeches of well-known lawyers are still being studied at the law faculties of our country and serve as examples of procedural speeches.

Fedor Alexeyevich Koni

Not all well-known lawyers were distinguished by such rare oratorical gifts as Kony FA, the son of a well-known vaudevilist, critic, editor and actress. The future judge and prosecutor received a home education, fluent in five languages. Kony FA actively participated in legislative activities, held high posts in the prosecutor's office, the judiciary, in particular, was the chairman of the Petersburg District Court.

Many high-profile cases were examined with the participation of this speaker. One of the most famous is the justice of Vera Zasulich, who tried to shoot St. Petersburg mayor because of a thirst for revenge for Arkhip Bogolyubov, who was the victim of bureaucratic arbitrariness. To the surprise of many, Kony AF managed to obtain an acquittal for Zasulich, who later became a famous Marxist revolutionary.

Koni AF actively continued to work and during the years of Soviet power, having accepted the revolution, this famous lawyer became a professor at St. Petersburg University, read many public lectures, enlightening the masses. Having lived to his old age, the brilliant orator until his last breath did not stop working for the good of the Fatherland.

Each of the personalities mentioned above is certainly an example of faithful service to the chosen case, and modern theorists and practitioners need to take an example from them.
