By his actions he covers the thief and becomes his accomplice. The punishment of such an "entrepreneur" is also provided for in art. 175 of the Criminal Code. As a result, both parties are guilty and must answer before the law.

The circumstances of the case

To apply this article, you need the most important feature - the subject of this crime, which is the same property that you tried to sell. It can be anything, with the exception of precious metals, hazardous materials, drugs and weapons. The sale of these items in the Criminal Code provides for punishment under other articles. In this case, we are talking about a transaction where one person obtained criminal property by some property and wishes to realize it. The other, for its part, is ready to buy it, despite the fact that, in fact, it acquires the crime subject.

At the time of the conclusion of the contract, he does not even think about it. Perhaps, both accomplices even know that there is such a art. 175 part 1 of the Criminal Code of the Russian Federation, but the desire for profit takes its toll and makes you commit wrong steps. There are situations that previously stolen things are given to someone as a gift or act as a payment of a debt. From this they do not lose their essence. An exception may be the fact that the items are given for a time, subject to a mandatory return. Here already the fact of permanent possession is absent, which completely changes the whole picture.

The final result in any case is a sentence. Art. 175 of the Criminal Code provides for the following violations of the following types of punishment :

  1. In part 1, relating to property, which was not a preliminary agreement, the guilty can receive: a fine of 40,000 rubles. Up to all types of income for three months, 480 hours of compulsory, up to two years of corrective and up to three years of forced labor, and also lose freedom for three years.
  2. Part 2 refers to cases where a group of persons acts according to a preplanned plan (collusion). In addition, the crime subject is oil (or products of its processing), cars or other expensive things. Here the punishment is more severe. In addition to limited freedom for 3 years, you can get six months of arrest, 5 years of forced labor, a solid fine - from 80,000 rubles. And up to the amount of a six-month income.
  3. Part 3 applies in cases where all previously described actions were performed by an organized group or led by a person who used his official position for this. Here the term of forced labor can reach five years with the possibility of partial deprivation of liberty. There is also a penalty similar to that described in part 2, with the possible exception of an additional two-year restriction of freedom.

Some consider any of these punishments too mild, but the law must always be humane and not allow unreasonable brutality.
