Possible penalties under Article 273 of the Criminal Code of the Russian Federation

The creator or distributor of malicious software for computers can limit in freedom. The punishment lasts up to 4 years. The conditional term is by no means the most serious measure applied to criminals.

It is also possible to make forced labor. Their maximum duration coincides with the limit of the conditional term. Namely 4 years.

Deprivation of liberty also takes place. It is stated that it will take 48 months to "sit out" and also pay an additional fine of up to 200,000 rubles. Either as a supplement to imprisonment to lose earnings for 1.5 years.

Groups

The creation, use and distribution of malicious computer programs can be punished by other measures. If the crime is committed for mercenary purposes, caused great damage or was a preliminary collusion, as well as the actions of an organized group or an act using the official position, then other forms of punishment will be applied to criminals.

As in the previous case, a conditional term is supposed. 48 months - this is its maximum duration. Forced labor is also not excluded. It can last up to 5 years. The deprivation of liberty is reputed for 5 years, additionally a fine is imposed in the range of 100 to 200 thousand rubles. To imprisonment can also impose a "taboo" on activities and work positions. Such punishment, according to Art. 273 of the Criminal Code, can last up to 36 months.

Severe consequences

If the creation and distribution, as well as the use of malicious software, caused serious harm or created a threat of their appearance, criminals may be "imprisoned" for 7 years.

In Article 273 of the Criminal Code of the Russian Federation, the commentary says that the offense is of a formal nature. This means that the consequences are not at all necessary. Already since the creation of malware, the criminal's guilt begins. And it does not matter whether the actions were socially dangerous or not. The motive also does not play a role for the crime.

The age of the offender is important. It must be at least 16 years old. Only then comes the responsibility under Article 273 of the Criminal Code.
