Parking on the sidewalks (SDA). Penalty for parking on the sidewalk

Today, in many cities, the rules concerning the parking of cars have changed. Leaving the car in the wrong place, you can quickly get a fine. In the article we will touch upon the question of what parking rules on the sidewalk apply and some adjacent to it.

Sidewalk

By this concept is meant the space where pedestrians move. It is separated from the road by a curb, planting trees or flowers, lawns.

Traffic regulations prohibit parking in this territory. There clearly spelled out the concept of the sidewalk, as well as the curb and footpath. Distinction is necessary, because pedestrians moving here, parked car hinders. Therefore, this issue is separately regulated by law.

Sidewalk and roadside

On the driver's side, you also need to be careful not to get that parking on the roadside caused a fine like parking on the sidewalk. In the SDA clearly stated that the roadside is a section of the road, adjacent to the roadway. And the roadside is on a level with it, but it can differ by another coating or marking.

The pavement is also adjacent to a part of the road for cars. Therefore, in practice, it sometimes happens that these concepts overlap. For example, when a strip of land with gravel is located next to the roadway, it is impossible to say with certainty whether it is a curb or a sidewalk. In such cases, proceed from the worst case, considering this part adapted for the movement of pedestrians. Then you can not worry about having to pay a parking fee on the sidewalk.

You should know that only drivers of mopeds and bicycles are moving on the roadside, and this is prohibited on motorcycles and cars. This part of the road can only be used when turning. However, this option is also acceptable when there is no other alternative.

On the sidewalks, cars can drive cargo or land passengers, that is, carry out the same actions as on the roadside. A stop or, even more so, parking in such places is prohibited. Exceptions are parts of roads where special signs are installed, on which parking on the sidewalk is permitted (or on the roadside).

Sidewalk and footpath

The concept of a pedestrian walkway implies a place where pedestrians or cyclists move. Such a site is allocated with a special sign. No parking or stopping at this place is allowed. Despite the fact that the SDA lead the concept of one and the other, to confuse the sidewalk and the footpath is not difficult. Motorists often neglect SDA and leave cars, explaining their actions by the fact that there are no borders on the road.

Is parking on the sidewalk permitted?

Of course, the answer to this question is negative. The penalty will be earned regardless of how many centimeters the driver drove to the sidewalk. Parking on the sidewalks is prohibited.

Some drivers argue that they do not interfere with anyone, they put the car on the spot permanently, 20 meters to the building is more than enough for pedestrians, and even with a stroller it's easy to pass. But such arguments do not play any role. There is a law, and traffic police officers write a fine, according to him.

Parking on the sidewalks can take place only with technical malfunctions of the car or force majeure cases. However, if this is the case, then it is necessary to provide strong evidence.

Near-tidal parking

To understand if parking is permitted on this territory, it is enough to imagine the realities of the city. Places for parking are not enough. Therefore, motorists are given the opportunity to park alongside the sidewalk. And in the SDA for this even introduced a special concept.

But parking on the sidewalks is allowed only in cases where there are special signs 8.6.2 - 8.6.9. According to them, the car can stand on arrival:

  • Only the right or only the left wheels;
  • All wheels only from the front or only from the rear;
  • Only front or only rear wheels.

The concepts of the sidewalk and the circumtidal parking are different. If the markup is missing, then it is not easy to understand the situation on the spot.

Penalty for parking on the sidewalk

Since the pavement is a specially designated area for pedestrians, traffic police officers have questions about the fact of parking in such a place. Justify in this case is possible only in the presence of force majeure circumstances. But this fact still needs to be proved.

The offense is spelled out in the Code of Administrative Offenses in Article 12.19. It says that violations of parking rules are punishable by a fine of 1,000 rubles in regional cities, and 3,000 rubles in Moscow and St. Petersburg.

In addition, the car is sent to the parking lot. Then you have to fork out for these "services." Payment in this case increases to 7,000 rubles. And if you add time and nerves to this, it will be even greater.

Penalty for driving on the sidewalk

Adequate driver will never come to mind to ride on the sidewalks. Well, if you want to ride, you have to shell out for 2 000 rubles. Of course, for someone and this amount will seem insignificant, but it is unlikely anyone will want to give it away. Unlike the fine, for the fact that parking was carried out on the sidewalks, the offender will have to pay for the ride equally: both in the city of federal significance and in the regional cities.

Penalty for parking on the lawn

To begin with, it is unlikely to find a definition for this notion today. Of course, not all areas with grass on them are called lawns. Therefore, it is not easy to understand the penalties.

However, especially inquisitive minds can look in regional legal acts. There is such a sign as the cropped grass. Thus, in a number of cases conclude: if the grass is not cut, then the territory is not considered a lawn.

In addition, it is not difficult to see that the amount of the fine in Moscow is slightly higher than in other cities. In the capital, there is a law on the protection of plantations. It defines the violations that damage the improvement of urban areas.

And the Administrative Code specifies the responsibility for such parking on sites with green spaces, lawns and playgrounds. Citizens will have to pay out an amount of 5,000 rubles, officials - from 10,000 to 15,000 rubles, and legal entities - from 30,000 to 100,000 rubles.

Where to complain

Pedestrians, who are tired of enduring flagrant violations of drivers, complain about the parking on the sidewalk. Where to complain in such cases, and how to do it right? If you decide to stop such actions, contact the regional traffic police. This is done as follows:

  1. The car is photographed from different sides so that the state numbers get in the frame and it was evident that there is no driver in the cabin.
  2. Go to the official website of the traffic police.
  3. Fill out the proposed form and attach photos in the same place, and also leave the data.
  4. Interestingly, the penalty for improper parking is set by the city authorities. Therefore, in different cities it is slightly different. Most often, you will not be able to avoid a fine, except when there is snow on the street, and you can not see the grass.

Proof of Offense

A driver will be punished if the traffic police officer sees parking on the sidewalk. SDA prescribe in such situations a fine. And if the car owner is not lucky, then the car will be taken to the parking lot. Evidence of the offense will be photographs, as well as testimony of witnesses or applicants who applied to the traffic police.

But if the driver sees the tow truck, he has the right to drive the car away. At the same time, he will have to pay a fine in any case.

The realities of today are such that even if parking is done on the sidewalk in the courtyard, the guard of the order is entitled to issue a penalty receipt. However, the driver has rights. In such cases, he may object by building one of the versions:

  1. Avoid a fine, he can, if at the time he was noticed, he held his hands behind the wheel. Then you can insist that there was a ride on the sidewalk.
  2. Another argument is the statement about the malfunction of the car.
  3. If there are no obvious signs on the sidewalk, the version is based on this fact.
  4. In addition, there are force majeure circumstances, when there was no way to do otherwise.

In any version of the penalty is removed or reduced amount. However, if the registration is carried out according to all the rules, the driver will not be able to "get out". Then it can be incurred so much that it would be much more profitable to stop on paid parking.

Conclusion

Thus, if you really need to park, and there is no other place nearby, do it without attracting the attention of traffic police. Take care that pedestrians can walk comfortably past the car.

Of course, these measures may not help, and the fine will have to be paid. Well, if this unpleasant fact does not stop there, then when you return to the parking lot, you will find that there is no car. This means that she was taken to the penalty parking lot. Then spread not only a higher amount, but also squander your nerves. Therefore, before parking, think: maybe the situation is not so extreme, and it is worth looking for a place where parking is allowed?
