Advanced training for 44-FZ (training for 44-FZ). Distance training courses

In order to continue to be a sought-after specialist, it is necessary to raise the level of professionalism, improve your own business status. A significant role in this process is played by additional education.

Features of advanced training in the field of procurement

Additional education of specialists is aimed at updating their theoretical knowledge and their practical skills. Its necessity is determined by the increasing demands for the training of employees. In the TC (Article 196, Part 4) provides for the duty of the employer to send specialists to the refresher courses. According to 44-FZ, when forming the commission of the customer, pre-emptive right of inclusion in it is used by persons who have undergone professional retraining. It can be carried out both with a separation from direct activity, and without it. In the latter case, specialists undergo distance training courses. Retraining can also be carried out with a partial separation from the main activity and under individual supplementary education programs. The latter are developed taking into account the specifics of the professional activities of a particular employee.

An Important Moment

Until January 1, 2017 as an employee of the contract service (manager) can act as a subject who has basic or additional professional education in the relevant specialty. In other words, he must undergo special training. According to the 44-FZ, the organization of additional education for specialists, as well as the issuance of relevant documents on its passage is under the supervision of the supervisory state bodies. As supporting papers, there is a certificate or diploma.

Additional education system

Training on 44-FZ is carried out within the framework of a uniform policy aimed at training contract service specialists. In order to ensure the proper implementation of legislative requirements, the Ministry of Education and Science together with the Ministry of Economic Development submitted proposals for the creation of an effective system for training employees and their state certification. In the general letter of the said ministries, addressed to institutions conducting educational work on additional programs, Methodological recommendations were sent. They explained the system, which should be upgraded for 44-FZ. The letter also noted that these Guidelines can be applied by customers when they purchase educational services.

The term of qualification upgrade for 44-FZ

In accordance with the previous governmental decree No. 610 of 26.06.1995, retraining is carried out as necessary. However, at the same time, an increase in the qualification for the 44-FZ should be carried out at least once every 5 years during all professional activities of the specialist. For individual employees, the employer may establish other periods. In paragraph 2.8 of the Recommendations, it is stated that the upgrading of qualifications under the 44-FZ should be carried out as required. At the same time retraining is advisable to spend at least 1 time in 3 years. This recommendation applies to all categories of specialists.

Additional programs

They are developed and approved by institutions that conduct educational work independently. At the same time, the requirements of the legislation for the level of training of employees involved in the relevant field are taken into account. It is recommended to improve the qualification for 44-FZ in full-time correspondence. The implementation of programs is aimed at improving or obtaining new competencies necessary for the effective implementation of professional activities. The results of the development of programs are determined by the final attestation of specialists.

Duration of retraining

It should be said that the norms clearly do not establish how long the advanced training on the 44-FZ should last. 120 hours is considered the optimal period, which is established by institutions that conduct educational activities. To clarify this issue, one should refer to the Procedure for the organization and implementation of retraining, approved by the Order of the Ministry of Education and Science No. 499 of 01.07.2013. In paragraph 12, in particular, it is established that the minimum duration of courses should ensure the possibility of obtaining the planned results announced in the program. At the same time, the duration of retraining should not be less than 16 hours. At the same time, in paragraph 2.3 of the Methodological Recommendations, there is an indication that the minimum duration of mastering programs should be set at least 108 academic hours. Exceptions are cases where the development of skills for 44-FL are held by the managers of enterprises-customers. For them, the duration of mastering programs can be reduced to 40 hours. The final certification is recommended to provide in the form of testing (examination) or defense of the thesis. Requirements for its scope, content and structure are established by the institution that conducts educational activities.

Refresher Courses for Civil Servants

For a correct understanding of the duration of their qualification improvement, reference should be made to Federal Law No. 79. Article 62 (part five) states that retraining of civil servants is carried out as necessary. At the same time, it is recommended to send employees to institutions for additional education at least 1 ruble / 3 g. As there is no other periodicity in the legislation, when sending specialists who are engaged in procurement to meet municipal and state needs, the training should focus on this period. Governmental Decree No. 362 of 06.05.2008 approved the state requirements for the retraining and training of civil servants. They, in particular, note that in-service training can be conducted to study the actual changes in certain issues related to their professional activities. In this case, the amount of development can be 18-72 ak. H. In paragraph 2 of the 17th item of the Order, approved by Order No. 499, it is established that for any kind of classroom lessons the duration of an academic hour is 45 minutes. If comprehensive updating of knowledge on some issues concerning the professional activity of employees is required, the volume of development should be 73-144 acres. H.

Note

Auditor is called the kind of contact work of students with the teacher. It includes lecture classes and seminars, group consultations or individual training. It also includes attestation tests (intermediate and final).

Depending on the chosen type of retraining (distance training courses or academic work), the duration of mastering programs can be in the range of 18-144 hours. Upon completion of the training, specialists who have successfully passed certification are given relevant documents. Their samples are independently determined by institutions that conduct educational activities.

In many large cities there are institutions in which it is possible to undergo advanced training for 44-FZ (St. Petersburg, for example). The program can include the following sections:

1. The work of the auction, tender, quotation commission of the customer. Responsibility of authorized persons in the Code of Administrative Offenses and basic offenses.

2. Procurement planning within the contract system (recent changes):

  • Recognition of unreasonableness.
  • New requirements for the form and content of schedules. Rules for the approval, formation and introduction of changes.
  • Procedure for calculating the total annual volume of purchases.
  • Rationing. Establishment of requirements for products, works and services or standard costs.
  • Necessity of indication in the plan, notification, schedule, contract and other documentation of the identification code.

3. Methods of procurement. Features of non-trading and trading operations.

4. Other procedures: limitations and opportunities.

5. The maximum (initial) cost of the contract. The need to enter information on the prices of products, services, works that are developing in the markets and placed by customers in the database.

Development of the task:

  1. Main shortcomings and mistakes. Detection of traps in technical assignments based on established practice.
  2. Specificity of counteraction to extremely shortened delivery times in procurement documentation.
  3. Errors in the formation of contractual services and commissions.
  4. The practice of detecting violations during the admission / non-admission of participants.
  5. Signs of blind purchases during the transition period of the formation of the contract system.

Other sections may be included in the program.

Conclusion

In the absence of federal standards and regulatory requirements for additional training programs for employees of the contractual services of the organization, on the basis of which advanced training is carried out for 44-FZ (in Moscow or any other city), they have the right to independently develop their content, establishing a different duration of their development. However, institutions should take into account that, according to the adopted Methodological Recommendations, the optimal period for retraining is not less than 108 hours, except for statutory exceptions. Specialists note that programs, the volume of which is 72 hours, are suitable for specialists of supplier enterprises. For contracting organizations, the duration of professional development should not be less than 108 hours, and for managers - at least 40 hours. Currently, there is an intensive change in domestic legislation. Periodically, corrections and additions are made to the current regulations, including those regulating the procurement for ensuring municipal and state needs. In this regard, it is necessary to update the knowledge of specialists engaged in this field in a timely and qualitative manner. In accordance with this, it is recommended that staff development be increased at least 1 ruble / 3 years. This will ensure an appropriate level of professionalism of contract service specialists.
