The main requirements in the field of construction are reliability and safety, compliance with all building codes. Previously, state control in this sphere was based on a system of licenses. The admission of the SRO in construction made it possible to simplify the licensing system as much as possible, without losing the quality of construction.

Self-regulating organizations

Admission SRO in construction - what is it? This can be understood only by understanding what is being created and how self-regulating organizations (SROs) are working . They are formed by combining at least 25 members who are subjects of entrepreneurship. The community uniting the subjects of professional activity must have at least 100 members.

The main activity of these non-profit organizations is the following: the creation of standards in professional activity, the verification of the implementation of the developed norms by the members of the organization.

Thus, the community of construction organizations regulates the standards that ensure safety at construction sites, the quality of the erected facilities and monitors their implementation. All the nuances of the work of such non-commercial partnerships are regulated by Federal Law No. 315 "On Self-Regulating Organizations".

All self-regulating organizations that have passed the registration and are compliant with the provisions of the Law are included in the state register of SRO permits in construction. It has all the self-regulating organizations on the territory of the Russian Federation, which unite construction companies (SROS). It maintains the register of SROS Rostechnadzor. It is important to remember that only SROS included in the state register have the right to issue permits.

How to get SRO admission and why it is needed

If you do not formalize the SRO admission, it will be impossible to obtain construction (contract). After all, admission is a guarantee that the company conducts all work taking into account the norms and requirements of the legislation. From the beginning of 2010 (from January 1), its availability is mandatory. Admission to construction works self-regulatory organizations give only their members, so the first task is to join one of them. Before joining it is necessary to find out:

  • Amount of contributions;
  • Compliance of issued permits with the list of works carried out by the company;
  • List of documents submitted.

After submitting an application and a package of documents in the SRO, some time passes for the verification of the claimed data, usually up to 30 days. If the level of qualifications of employees, constitutive and other documents meet the requirements of the self-regulatory organization, then after payment of contributions within 3 days, an admission is issued.

Admission for which period is allowed

The period of validity of the permit is not limited by legislation. It is not limited to its effect and on territorial grounds - the admission is valid throughout the Russian Federation. This is convenient, since it is possible to join the SRO not on a regional basis, but to choose the most convenient option.

However, there are two options for when the admission is considered to be invalid. The first is the exit of the business entity from the SRO. Then the community has no right to control the activity of the subject, and accordingly - to guarantee the quality of his work and bear responsibility for them. The second option is a violation of the law.

Do I always need a certificate of admission

Tolerance is required if the ongoing construction or reconstruction work affects the level of safety. How do you know which types of work are required to admit SROs for construction? List No. 624 contains all the construction works for which tolerance is required.

But in practice, in case of the company's participation in tenders or its work with the state customer, membership in a self-regulatory organization will most often be mandatory, even if the works performed are not in the List (at the request of the customer). Separately, it should be noted that if the company has expanded the list of services provided, and in its SRO for these types of certificates are not issued, then you can join another self-regulating organization in parallel.

Where tolerance is not needed

In the text of the Town Planning Code there is a list of construction objects for which tolerances are not necessary:

  • Garages for individuals who do not carry out business there.
  • Buildings that do not relate to capital objects - stalls, canopies and so on.
  • Buildings of auxiliary use.
  • Detached houses up to 3 floors (individual development).
  • Detached houses, which have no more than 10 blocks and not more than 3 floors (blocked building).
  • Residential houses consisting of not more than 4 block sections and 3 floors (multi-apartment).

Tolerance is not needed for changing capital construction objects, if they do not concern the restructuring of structural elements.

Access for general contractors

The types of SRO permits in construction include the general contractor's admission. It is necessary if the company that received the contract attracts third parties to perform part or all of the complex of works (item 33 of the List - organization of construction with the involved contractors). This document is necessary due to the fact that, by concluding a general contract, the company assumes full responsibility for the quality of all works. And those that perform independently, and those that are performed by a subcontractor.

The certificate of the general contractor allows you to conduct all activities in the legal field - to enter into contracts with other companies and monitor their activities. If the customer decided to attract subcontractors and coordinate their activities (that is, to perform the functions of general contractor), then he also needs to join the association of general contractors and get the appropriate SRO admission in construction.

Admission to control

Construction control - technical supervision - can be carried out by organizations that have SRO admission in construction for this type of activity. In most cases, such a permit is received by the company-developer or general contractor. If there are no relevant specialists in the staff of the company of the customer or the general contractor, then a third party is involved in the control.

In List No. 624, this kind of work (construction control) goes under item 32. The competence of the company that conducts technical supervision includes checking on compliance of certain production processes and the entire technological cycle in construction with all norms of legislation and project documentation.

Can SRO admit foreign companies

The law stipulates that a foreign company can also obtain admission of SROs in construction, and on general grounds. However, there is one caveat - the company is obliged to register a branch in Russia (to receive admission and be a member of the SRO will not be the whole company, but only its branch). Certificates of equivalence of the diploma of foreign specialists to diplomas of the state model of the Russian Federation should also be provided.

The entry of foreign and Russian companies into the SRO means the implementation of their activities in the legal field. This form of regulation can significantly reduce government interference in the production processes of entrepreneurs, without reducing the bar on the safety requirements of the constructed facilities. For entrepreneurs, obtaining access without resorting to state authorities is a significant time saving.
