Which laws govern the compilation of the calendar

How many working days will be reflected in this document and how many festive - information that is directly dependent on the standards specified in the Labor Code of the Russian Federation. So, according to Article 112 (Part 2), if the day coincides with the weekend, the last one is postponed to the working day (first day) after the holiday. That is, for example, if March 8 falls on Sunday, rest is laid on Monday. In addition, under the same article, the preceding working day is reduced by one hour.

According to the changes made to the mentioned article of the code 23/04/12, the government is given the right to transfer two days off of New Year's holidays for any working days in the year (current). For example, this decision was made in 2013. January weekend supplemented non-working days for the May holidays.

There is also part five of the article 112, according to which the weekend can be transferred by the Government of the Russian Federation (a special resolution). Such a law allows workers in certain situations to use their personal time much more rationally. For example, if the holidays are on Sunday and Monday, the day off can be transferred not on Tuesday, but on Friday.

Also, when compiling the production calendar, Article 110 of the LC RF is taken into account, according to which the number of hours of rest (continuous) should not be less than 42.

Calendar for 2014

The number of working days a year, as the reader has already understood, is directly dependent on the Government of the Russian Federation, which makes up the production calendar. What is it that made us happy in 2014? So, according to this document, festive, and therefore, non-working days this year will be the following:

  • 1 - 6 and 8 January - New Year;
  • 7/01 - The Nativity of Christ;
  • 23/02 - Defender of the Fatherland Day;
  • 8/03 - 8 March;
  • 1/05 - Spring Festival;
  • 9/05 - Victory Day over fascist Germany;
  • 12/06 - Day of Russia;
  • 4/11 - Day of Unity.

Thus, this year we rested 8 days for the New Year. On the eighth of March non-working days will be 3 (from 8 to 10). In May, we rest for 4 days (1 - 4) for the holiday of spring and Victory Day - 3 days (9 - 11). And four more days off are waiting for us in November (from 1 to 4). If to make simple calculations, it turns out that the number of working days this year will be 247, as well as in 2013. The number of workdays reduced by one hour is 6. The non-working days, including all weekends, will be 118. Of course, all these calculations correspond to the working five-day period.

Working time norms

Of course, it's worth knowing not only about how many holidays are given to employees in each specific year, but also about how many hours it can work in a certain period of time (maximum). Similar issues are regulated by Article 91 of the LC RF. For example, the number of working hours per week can not exceed forty. At the same time, every employer (regardless of the legal form of the enterprise) must necessarily take into account the actual time worked by each employee.

Who is allowed the reduced number of hours

Working days of the week can be reduced for certain citizens. Of course, this is also worth knowing to everyone.

  1. For workers under 16 years the number of hours worked per week should be reduced by 10.
  2. Older than 16, but under the age of 18 - for 4 hours.
  3. Persons with disabilities will have to work less for 5 hours.
  4. In the areas of production with harmful working conditions, the working week should be reduced by 4 hours (or more).
  5. For workers in chemical industries listed in the law, a 36-24-hour week can be established.
  6. Less time will have to work and pregnant women in the Far North.

Thus, no one should work more than 40 hours, regardless of whether a five-day or six-day week is provided for at the enterprise.

Five- and six-day week

The duration of each working day is determined primarily by the internal regulations of the particular company. Of course, the law regulates this issue. According to the regulations, working days in Russia are five days from Monday to Friday inclusive. However, this condition is considered mandatory for execution not in all cases. By law, the employer, based on the specifics of production, can establish a six-day week. Thus, in some enterprises employees work extra on Saturday or Sunday. However, the maximum number of hours per week established by law is observed in any case.

What counts in working hours

Of course, the law regulates this issue. Working hours - hours during which the employee in accordance with the employment contract fulfills his duties. This regime is one of the essential conditions of this document, which can be drafted only taking into account the norms of the Labor Code of the Russian Federation.
