Riding without numbers - is it worth the risk?

On the forums of motorists and just in companies, sometimes the question is raised - can I drive without numbers? What is fraught with such a violation? What is the amount of the penalty and whether it can somehow be avoided in exceptional circumstances (for example, the number is lost or stolen right on the trip, or the car is just bought and you go on it just behind the numbers). What does the driver expect in this situation in the event of a meeting with the traffic police inspector? Let's figure it out.

On the Internet, a lot of tales and true stories about how riding without numbers, the penalty for which has always been severe enough, in fact proved to be not so dangerous. As "for free" drivers "otmazyvavilis", leading "serious" arguments such as "just lost a number, I'm going after a new one" and got off with a symbolic fine of a hundred rubles, or even a warning.

The situation with one missing number was seriously discussed. Say, when making claims by the traffic police, we reasonably answer that there is no such interpretation in the code, we are talking not about numbers, but about registration marks, and we are just going to re-register, so, in addition to a fine of 100 rubles for an unreadable Number, no longer disagree. Strangely enough, such arguments are sometimes "rolled". But we hasten to disappoint (and warn!) - the "freebie" is over. Since February 2012 by the Supreme Court ruling, riding with one number is equivalent to driving completely without numbers with all the ensuing consequences.

So what kind of punishment awaits us for such a violation, as driving without numbers? According to Part 2 of Art. 12.2 of the Code of Administrative Offenses of the Russian Federation driving a car without registration marks or with fixed in unintended places, or difficult to read (identification of which is difficult) is punishable by a fine of five thousand rubles. Or deprivation of the right to manage the vehicle for a period of 1 to 3 months. The most serious is the temporary deprivation of the driver's license, which is similar for many people.

Great measures, is not it? So let's take a closer look at the nuances of the situation called "riding without numbers."

First of all, remember that, according to the new version of the Code of Administrative Offenses, the requirements for state registration numbers are as follows:

  • Their actual presence in the car;
  • Installation in the place provided for this (where there is a special frame). This means that carrying numbers with you in the trunk or under the glass - it's like not having them with you at all. From the point of view of the law, this is also a ride without numbers!
  • Numbers should be easy to read, that is, any masking elements are excluded. Nothing should hide the number from the eye of the inspector. Therefore, it is better to remove all curtains, grids or drawings - all this works against you.

And if driving with dirt-stained numbers is a bit different, then any of the above situations falls into the category of "driving without numbers" and is punished according to the gravity of the law. It is not even known what is worse - to give away 5,000 or lose, temporarily, right. For many people in our time, due to the conditions of modern urban life with its mobility and long distances, to lose the rights (that is, to change for public transport) means to break the habitual way and to break many plans. And someone is required every day for their professional activities. So think seriously, do you need such problems.

Of course, it is difficult to foresee all situations. Recently, one of the forums raised the question of the legitimacy of the actions of a traffic police officer who stopped a car without numbers and fined the driver. The "chip" was that the driver just got the numbers for the new car he bought, but could not be screwed in place - the holes did not match the fasteners, and drove them home to fasten. Attempts to explain the situation, as usual, ended in nothing.

The driver's indignation, from a purely human point of view, is understandable, but (alas!) Formally (that is, by law), the inspector had the right to fine him - he was driving without numbers! With the adoption of the new Code of opportunity to "get out" in this and similar situations is almost not left. So do not want trouble on your head - do not rely on the logic of the situation or the "human factor". It is better to plan in advance all possible future problems. For example, when going for the numbers (as in the case mentioned), buy in advance and throw in the trunk special mounts for license plates and a set of tools.
