Sometimes it is possible to solve this problem quite simply and easily, but sometimes it is necessary to seek justice in court. And it is in this case that it becomes possible to collect so-called indebtedness under the ID.

What is the debt under the ID? This is the payment of a loan debt, a receipt or, if necessary, payment of maintenance even if the debtor himself does not know about it. It is issued on an executive document, which can be issued in court.

What is the executive document?

This paper can only be given to the recoverer by a court. It is an official document by which the recoverer, without the knowledge of a debt defaulter, can write off some of the funds from his account. In addition, the executive document gives the recoverer the right to file claims with the debtor in court.

Since this document is official, it can be considered valid only if it is signed by a judge and there is a special seal on it with the coat of arms of the judicial body. In case of insolvency of the debtor, the debt under the ID may be paid off with the help of his property. That is, the court has the right not only to arrest the property of the defaulter, but also to evaluate it and put it on sale. In this case, the recoverer is given a choice: either take on the payment of arrears of some of the property, or withdraw money from its sale.

How is debt repaid under ID?

Debt on the ID makes it possible to repay it periodically, as a rule, once a month. This is quite convenient, since the payer does not need to constantly remember the payment period, they will be repaid automatically. Most often, the payment period is tied to a certain date, for example, to a salary, a scholarship or a pension.

What else do you need to know about paying off debts under the ID?

It must be understood that from the very first day, when the court issued an executive paper, the first period of the payment period begins. If the payer does not pay the required amount of money until the last working day of the current first period, then it will violate the rights of the recoverer. In this case, it will be considered as evasion of payment of debt and can lead to serious consequences.

As a rule, ID debt is paid in the event of maintenance, when the frequency plays an important role. But it also happens that the creditor agrees to receive the debt in installments, and the court can decide to issue the enforcement document to the recoverer.

Even if you won the court and received executive documents, this does not mean that the debtor will accurately pay the debt. What to do in this case to the recoverer in order to get his legal money?

If the debt of a defaulter is less than 25 thousand rubles, then all official documents can be sent to the employer of the debtor. In the same case, if the amount is much higher, then it is necessary to send the executive documents to the bailiff at the place of residence of the defaulter. Documents must necessarily be enclosed with the statement signed by the claimant. Among the bailiff's powers, the application of various sanctions takes a special place, up to and including a ban on leaving the country.

It is worth remembering that if the debt is paid out of the salary, the recoverer will receive money within three working days after the agreed date. So be prepared that you will receive the money later.
