Movement along the roadside. Violation of traffic rules. Penalty for the roadside

In traffic rules, traffic on the roadside is now punishable by a fine. At the same time, its size is rather large. However, many impatient drivers ignore the rules and still try to overtake standing cars during the congestion, moving along the roadside.

What is a shoulder?

In the rules of the road there is a notion that the roadside is an element of the road. Its beginning is usually limited to marking 1.2.1 or 1.2.2 of the current SDA. If there are no markings, then, as a rule, the roadside is different from the asphalted road surface. Usually it is ground.

It should be noted that in spite of the fact that the roadside is an element of the road, it is strictly forbidden to ride it . Movement on the roadside SDA permits only in the most rare situations, for example, when the journey was completely blocked due to a serious traffic accident.

Recently, patrol inspectors are particularly strict about those violators who, despite the rules, still continue to overtake or move along the roadside.

Why so strict?

In fact, this behavior of DPS inspectors is quite understandable if one understands why the roadside was recognized as an element of the road and for whom it is intended.

Traffic on the roadside is allowed only for pedestrians, cyclists or mopedists.

On busy roads, there are often situations when an intruder, walking along the roadside, sees a pedestrian and starts signaling to him that he immediately gives way to him. However, in this case, the driver will be wrong, and if he hits a pedestrian, then in this case he will be punished with all the severity of the law.

Therefore, experienced drivers who are not used to overtaking the "cork", strongly recommend violators not to go to the roadside, because back to stop in a row of standing cars will be even more difficult.

Penalty for the roadside

The amount of the penalty for traffic on the roadside depends primarily on the side on which the driver moves.

So, if the intruder decided to ride along the roadside on the right, then in this case the inspector, after seeing this violation, will be ready to write him a fine of 1,500 rubles.

There are also such drivers who, despite the danger, try to overtake the traveling cars and on the left shoulder, that is, on the opposite side. Such a call the inspector can regard as a violation of the rules of overtaking and as the exit of the vehicle to the oncoming lane. The penalty for the roadside in this case will be more serious. Can even reach and deprivation of rights.

In addition, if in a similar maneuver the driver could not immediately return to his lane, he could be discharged and another fine - for creating an emergency situation.

The penalty for such a misdemeanor is 5,000 rubles. The court can also deprive the violator of the driver's license for up to six months. If the driver decides to test the fate again, the deprivation for such an act will be increased to one year.

Who can go around on the road?

Despite such a severe punishment for drivers of cars and an absolute ban on traffic on the roadside, there is a category of transport that has the right to move on this element of the road without fear of getting a fine.

This category includes road service vehicles, as well as loaded wagons. Moreover, wagons have the right and stop at the roadside, if the point where they drove the goods is in close proximity to it.

Also, some more vehicles can move along the roadside if they do not interfere with pedestrians. Among them:

  • Bicycles, if the person who manages them is over 14 years old;
  • Mopeds can also continue to move along the sidelines, paragraph 24.7 (SDA) confirm this;
  • Carts and other live transport.

Moving on the side of the bike

Velosepidists, who are over 14 years of age, can move only on specially designated tracks. They are called bicycle. If such roads do not, then adult cyclists can drive along the usual road, taking the right position at the same time. The rules of cycling on the roadside say that you can move around this road element only if there are no bike paths, and you can not move along the roadway.

This rule applies only to cyclists over 14 years of age. If the driver is younger than this age, then he has the right to move solely along the sidewalk or to places that fall under the concept of a residential area.

Riding on the roadside of mopeds

Now it is worth paying attention to mopeds and scooters, whose drivers do not follow any rules set. So, as it is written in the rules of the road, which not so long ago came into force, the moped drivers are obliged to move only along the carriageway and only pressed themselves to the right side.

The movement of the moped along the roadside is also not prohibited by the rules, however this can be done only in the most extreme cases and only if there are no pedestrians on the roadside and their movement will not be impeded by the moped.

It is also worth noting that, in comparison with the bike, the moped has much more restrictions on the rules of movement. For example, moped drivers are strictly forbidden to move around bicycle paths and pedestrian zones. They are also prohibited from moving along the sidewalks.

In which cases can cars move along the roadside

It's no secret that traffic on the roadside can not only cause small traffic accidents, but it can even increase the traffic. In addition, such quick violators irritate already nervous drivers who are not the first kilometer in the jam.

Despite the fact that the rules of riding on the roadside are strictly prohibited, there are also situations where the driver simply does not see any other way out, like moving along the edge of the road.

Road service inspectors sometimes turn a blind eye to such a violation. But only in exceptional situations. In order to understand what situation is exceptional, it is necessary to give an example.

So, you can imagine that on the road there was a major accident. Several cars were damaged in it. During the impact of the vehicle carried to the next lane, as a result of the accident blocked the movement of cars in all directions. It is in this case that the driver does not have any other way out, like moving along the roadside.

It is clear that this example is an exceptional situation. In other cases, the driver should overtake cars caught in an accident only on the opposite lane, but by no means by the wayside.

How are "catching" violators now?

Of course, if the intruder moves along the roadside and sees the inspector of the DPS, he will immediately reorganize into his own series. In this case, the guardian of the order may not notice the violation. But now a new technique is being introduced to identify violators.

For example, in large cities for a relatively long time began to work cameras automatic fixing violations. It should be noted that many drivers are skeptical about this, but those violators who have already received fines for driving on the sidelines at a rate of 1,500 rubles think completely differently.

Indeed, unconditional punishment by the ruble is much more effective than talking with the inspectors of the DPS. The intruder has received a fine and will have to pay it off so as not to make trouble with the law. It is interesting that this has long been confirmed on real examples, when, after paying one penalty, the driver no longer climbs to overtake on the sidelines.
