"Stankomash" paid for errors bailiffs

Several news agencies continue to speculate about the situation at the Chelyabinsk plant "Stankomash". By malicious intent or by the thoughtlessness of some journalists, information about certain illegal schemes of netting, as well as about the non-existent financial collusion of the enterprise management and bailiffs is thrown in. For some reason, no one addressed the comment to the management of the enterprise.

It all started in 2004, when the plant got into a difficult situation, executing an unprofitable, but mandatory order of defense value. Payment came to the enterprise in parts and out of time. There was a financial imbalance. He led to disruptions in terms of payment of wages and violated the schedule of tax payments.

As a result, by 2007, a debt was formed. According to the collection procedure, it was decided to transfer part of the property of OJSC Stankomash for sale. The factory base of rest "Rodnichok", located on Lake Chebarkul, was to be alienated. According to the management of the enterprise, the cost of Rodnichka was 87 million rubles, the Office of the Federal Service of Tax Bailiffs in the Chelyabinsk region insisted on the amount of more than four times less - 20 million rubles.

In 2009, the property was sold exactly at this price and 20 million rubles went to the account of the regional bailiff service. The factory workers tried to challenge the unfavorable conditions for selling the recreation center in the arbitration court. The proceedings dragged on until 2011, when the Supreme Arbitration Court finally accepted the side of the bailiffs.

During the period of litigation, the money received from the buyer was "frozen." And all this time the factory had to solve problems with payment of the salary and taxes independently! When, at the end of 2011, the bailiffs decided to send money for the intended purpose, it turned out that part of the amount had disappeared! In response to the requests of the management of the plant, the bailiff's office responded that "a significant portion of the money received from the sale of the Rodnichok recreation center has been stolen." What happened?

On the basis of the order on UFSSP No. 152 dated 02.12.2011 the inspection of executive proceedings took place. This audit was initiated by the management of the Office in connection with the initiation of a criminal case against bailiff E.S. Fedyashkina on the grounds of the crime provided for in Part 4 of Art. 160 UKRF. The convict is charged with embezzlement of funds (transfer of money to the account of persons who are not parties to enforcement proceedings) in the period from spring 2009 to the end of summer 2011. As a result, the shortage amounted to more than 8 million rubles.

And although the remaining 12 million on the accounts of the Office were immediately allocated to the recoverers, the result of this story is disappointing: it was Stancomashu who had to pay for someone else's mistakes. Because of the unprofessional actions of state officials, the enterprise actually became twice injured - at first the Rodnichok base was sold four times cheaper than its market value, and then even from this understated amount, dishonest officials managed to steal two-fifths.
